Waiver and Release for using Sniffspace – Guest & Dog

Thanks for using Sniffspace! All forms of activity have some form of associated risk. By signing this waiver, you understand that you and anyone that accompanies you in the use of a Sniffspace with your dog do so at your and their own risk (and the risk of your dog). You and you alone are solely responsible for supervising your dog and determining whether or not this is an appropriate activity for your dog's age and abilities.

You list your space and utilise the Sniffspace platform at your own risk and any property listed on the platform is open for renting by a guest. You acknowledge that any risk associated with using such a platform, or insurance required is solely yours and yours alone and you indemnify Sniffspace and any of its subsidiaries of any liability associated with this risk.

This Waiver and Release refers to “your dog” “my dog” or “the owner of the dog” and these terms include you, whether you are or you are not the legal owner of the dog. You are the person responsible for the dog while using this facility and you will be responsible for your dog at all times whilst using a Sniffspace.

Warning of Risk

Dog activities are intended to provide a fun and rewarding experience for you and your dog, however all activities come with some form of risk. Even if all care is taken and proper preparation has been undertaken, there is still a risk of serious injury, including death to the dog, its owner/handler or other persons or animals. Understandably, not all hazards and dangers associated with dog activities can be foreseen. It is your duty to take care, check your surroundings and inspect any fences and property that you are entering before you let your dog off-leash in an unknown area.

Certain inherent risks include the propensity of any dog to behave differently in an unfamiliar environment, and this behaviour may result in damage to property, injury to you, another person, your dog or another dog.

Other risks include, but are not limited to, the inexperience, negligence or irresponsibility of a dog owner/handler; the inability to predict a dog’s reaction to movement, sounds, objects, persons, or other animals; and actions by the dog due to fright, anger, stress, insect bites or natural reactions such as jumping, pulling, resisting and biting. Other risks can include the hazards associated with environmental and traffic conditions, potential communication of diseases, fleas and other parasites, acts of God, inclement weather, slips and falls, premises defects, equipment failure, failure in instruction/supervision, and all other circumstances inherent to dog and/or outdoor activities. Spaces themselves frequently have hazards: bodies of water, bushland, domestic animals, farm animals and many other hazards.

You understand that it is impossible for Sniffspace to guarantee yours and your dog's absolute safety. Should you attempt to break up a dog fight or restrain a dog, including but not limited to your dog, you may be severely mauled and/or attacked by your dog or other dogs or another dog’s owner/handler.

Waiver and Release

Please read this form carefully and be aware that in consideration for permission to use this private space, you will be expressly assuming the risk and legal liability and waiving and releasing all claims for injuries, damages or loss which you or your dog might sustain as a result of participating in any and all activities connected with and associated with use of this facility and surrounding areas.

By your confirming this waiver, you recognise and acknowledge that use of this private space and the surrounding areas for dog activities and participating in dog activities entails certain risks of damage, loss or injury to animals, persons or property (including to you, other persons, your dog and other dogs or animals), and you voluntarily agree to assume the full risk of and responsibility for any injuries, damages, loss, liability, costs and expenses, regardless of severity, extent or amount, that (a) you, your dog or any other person accompanying you might sustain or incur as a result of your presence in this private space and surrounding areas or you participating in any and all activities connected with or associated with use of this private space and surrounding areas or (b) any other person or animal might sustain as a result of your or your dog’s actions or conduct in connection with or arising out of your presence in this private space and surrounding areas or you participating in any and all activities connected with or associated with use of this private space and surrounding areas.

By your confirming this waiver, you hereby agree to waive, relinquish, release and forever discharge (a) the host of this private space whether it be an individual or a corporate entity, (b) Sniffspace and its officers, employees and agents, and (c) any volunteer assisting or working on behalf of the host, Sniffspace or any of their officers, employees or agents (including but not limited to, any volunteer that is an officer, employee or agent of Sniffspace or the host), from any and all claims or causes of action for damages, injury, loss, liability or expenses that you may now have or which may accrue hereafter to you or any other person claiming through you or on your behalf and arising out of, connected with, or in any way associated with use of this private space and surrounding areas.

By your confirming this waiver, you further agree to indemnify and hold harmless and defend (a) the host of this facility whether it be an individual or a corporate entity, (b) Sniffspace and its officers, employees and agents, and (c) any volunteer assisting or working on behalf of the host, Sniffspace or any of their officers, employees or agents (including but not limited to, any volunteer that is an officer, employee or agent of Sniffspace or the host), from and against any and all losses, claims, damages, liabilities, cause of actions and expenses (including but not limited to court costs and attorney’s fees) occurring, growing out of, incident to, or resulting directly or indirectly from your use of this private space and surrounding areas, including without limitation any losses, claims, damages, liabilities, cause of actions and expenses on account of personal injury to or death of any person or animal, or damages to property of any person or entity.

By confirming this waiver, you further agree that you are solely responsible for all actions of your dog and yourself, as well as any damage or impact that comes from the actions of your dog or yourself.

Any dog handler must confirm this Waiver and Release. That means that if more than one person in your household brings your dog to the private space, each such person must confirm this Waiver and Release. Any person under the age of eighteen (18) will require the confirmation of a parent or legal guardian.

I CONFIRM THAT I WILL ABIDE BY ALL RULES OUTLINED IN THE USE OF SNIFFSPACE AND ANY PRIVATE RESIDENCE I MAY ENTER.

I HAVE READ AND UNDERSTAND THE ABOVE INFORMATION, OVERVIEW OF RISKS, ASSUMPTIONS OF RISK AND WAIVER AND RELEASE OF ALL CLAIMS. I ALSO UNDERSTAND THAT MY DIGITAL SIGNATURE WILL BE LEGALLY BINDING AS I AM COMPLETING THIS WAIVER AND RELEASE IN A DIGITAL FORMAT.

Waiver and Release for using Sniffspace - Hosts

Thanks for using Sniffspace! This waiver forms part of our terms and conditions for the safe use of Sniffspace and its associated sites. You understand that listing your backyard on a sharing site means that your address will be made available to any guest that books your space.

You understand that you are listing your space for the exclusive use of dogs and their owners and therefore any damage caused by fair use of your space or accidentally by a guest and their dog/s is your responsibility. Fair wear and tear may include, but is not limited to the following:

Run patches in grass
Digging
Uprooting of plants
Excess fur on outdoor furniture

You agree to take the reasonable and necessary precautions in the prevention of damaging personal valuable and items. This can include but is no limited to:

Securing areas you do not intend for a guest or dog/s to enter
Removing any personal valuables or fragile items from the designated areas to mitigate risk.

Warning of Risk

Dog activities are intended to provide a fun and rewarding experience for a dog, and therefore there may be barking and excitement accompanying those activities. It is your duty of care to inform neighbours of your listing and provide a safe place to park and access to your Sniffspace that will not interfere with your neighbours or surrounding areas.

Other risks can include, but are not limited to, the inexperience, negligence or irresponsibility of a dog owner/handler; the inability to predict a dog’s reaction to movement, sounds, objects, persons, or other animals; and actions by the dog due to fright, anger, stress, insect bites or natural reactions such as jumping, pulling, resisting and biting. You will, to the best of your knowledge, remove any hazards from your space that could cause injury to your guest and their dog/s. These include the hazards associated with environmental and traffic conditions, potential communication of diseases, fleas and other parasites, acts of God, inclement weather, slips and falls, premises defects, equipment failure, failure in instruction/supervision, and all other circumstances inherent to dog and/or outdoor activities. Spaces themselves should be devoid of hazards such as: bodies of water (unless listed and signposted), bushland, domestic animals, farm animals, broken glass or unrepaired fencing.

You understand that it is impossible for Sniffspace to guarantee that no guest will cause damage to your space.

Waiver and Release

Any space host must confirm this Waiver and Release. You must be the listed owner of your property to enter into such an agreement. Any person under the age of eighteen (18) cannot list a space, and therefore cannot legally sign this waiver.

I CONFIRM THAT I WILL ABIDE BY ALL RULES OUTLINED IN THE USE OF SNIFFSPACE AND I LIST MY PROPERTY AT MY OWN RISK.
